These Terms of Service (“Terms”) govern your use of the iziSalon platform, website, and related services (collectively, the “Service”) operated by IziSalon Inc., a company incorporated under the laws of Canada (“IziSalon”, “we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Overview of the Service

IziSalon provides a cloud-based Software-as-a-Service (SaaS) solution for beauty and wellness businesses to manage appointments, customers, staff, inventory, marketing, and business operations.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under applicable law to use the Service. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind such entity to these Terms.

3. Account Registration

To use certain features, you must create an account and provide accurate, current, and complete information. You are responsible for safeguarding your password and all activity under your account. You agree to notify us immediately of any unauthorized use or security breach.

4. Subscription and Billing

  • The Service is offered on a subscription basis.

  • All prices are listed in Canadian Dollars (CAD) unless otherwise indicated.

  • By subscribing, you agree to pay the applicable fees as described at the time of purchase.

  • Payment is processed through third-party providers, and you authorize us to charge your payment method for recurring fees.

  • You may cancel your subscription at any time, but no refunds will be issued for the unused portion of the term unless required by law.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable Canadian laws and regulations. You shall not:

  • Use the Service for any illegal, harmful, or fraudulent activity.

  • Reverse engineer, decompile, or attempt to derive the source code of the Service.

  • Interfere with or disrupt the performance of the Service or attempt to access data not intended for you.

6. Data Ownership and Privacy

  • You retain full ownership of any content, data, or information you upload or store via the Service (“Customer Data”).

  • We process and protect your personal data in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). For more details, see our Privacy Policy.

  • By using the Service, you grant iziSalon a limited license to use your Customer Data solely to deliver and improve the Service.

7. Termination

Either party may terminate these Terms at any time by providing written notice. Upon termination:

  • Your right to access the Service will cease.

  • We may delete your data after [e.g., 30 days], except as required to comply with applicable laws.

8. Intellectual Property

All intellectual property rights in the Service, including software, trademarks, and all related materials, remain the exclusive property of iziSalon Inc. or its licensors. Your use of the Service does not transfer any ownership rights.

9. Disclaimer

The Service is provided “as is” and “as available.” To the fullest extent permitted by Canadian law, iziSalon disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, iziSalon shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, data, or business opportunities, even if advised of the possibility of such damages.

In any event, iziSalon’s total liability for any claims under these Terms is limited to the amount paid by you to iziSalon in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless iziSalon, its officers, directors, employees, and affiliates from any claim or demand, including reasonable legal fees, arising from your use of the Service or your violation of these Terms.

12. Changes to the Terms

We may update these Terms from time to time. If changes are material, we will notify you via email or through the Service. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Toronto, Ontario.
